Californias Overcrowed Prisons Free Online Research Papers California’s Overcrowded Prison’s Axia College of University of Phoenix This is what conditions are like at one of Californias best prisons, the California Rehabilitation Center: Built to hold 1,800 inmates, it now bulges with more than 4,700 and is under nearly constant lockdown to prevent fights. Portions of the buildings, which date to the 1920s, are so antiquated that the electricity is shut off during rainstorms so the prisoners are not electrocuted. The facilitys once-vaunted drug rehab program has a three-month-long waiting list, and the prison is short 75 guards.† (Pomfret, J) 32 years ago, California’s inmate population was only 19,600. 11 years later, the inmate population had increased by 811% to a whopping 159,000 and by the year 2000 that number increased to 161,000. The state of California is now running by far the largest prison system in the world. We house more inmates than three European countries (France, Germany, the Netherlands) and Singapore combined. Non-violent offenders are responsible for most of the increased inmate population. As it stands now, California sends to prison one out of every eight prisoners in the United States. Does this sound like a problem? I think so. â€Å"The California Department of Corrections predicts that at the current rate of expansion, barring a court order that forces a release of prisoners, it will run out of room eighteen months from now. Simply to remain at double capacity the state will need to open at least one new prison a year, every year, for the foreseeable future.† (Schlosser, E) T his is a scary thought indeed. How many more prisons must we have in this state before enough is enough? In this graph, one can see the increase of inmate population from 1988-2007. The numbers are staggering. Even though the Governor does not want to do an early release of as many as 55,000 inmates, there is a crisis going on in California’s 33 prisons because of overcrowding and because of the lack of medical and mental healthcare for its inmates, thus causing cruel and unusual punishment and violating the inmates Eighth Amendment rights. These inmates are either being housed in gymnasiums using bunk beds that are three beds high, or are being sent out of state to other facilities. In this picture, one can see how inmates are being stacked like sardines in gymnasiums across California. In February, a special panel made up of three federal judges upheld a tentative ruling that the overcrowding in California’s prison system presented and unconstitutional risk to the inmate’s health and safety. They further stated that California must reduce the population of its prisoner’s by at least 57,000. Currently, there are 174,000 inmates housed in California’s 33 state prisons. The stress from packing these inmates into facilities that were not meant to hold as many as they are, have resulted in scandalous behavior, not only from the inmates but the guards as well. Riots among inmates are a common occurrence. Back in September 1996, a fight broke out on B yard at New Folsom. Gang members that were comprised of Latino and African-Americans started fighting. Soon afterwards, â€Å"the fighting spread to other inmates on the yard and racial lines were drawn†. At least 200 inmates were involved in the riot. Warning shots were fired by officers, along with rubber bullets and live rounds. The riot took 30 minutes to cease. 12 officers were injured, â€Å"six inmates were stabbed, and five were shot.† An inmate who had been serving a sentence of 18 years for voluntary manslaughter and attempted murder was killed by the gunfire. (Schlosser, E) At Corcoran State prison , the guards had to be disciplined for staging gladiator fights. Up in Northern California at Pelican Bay State prison, there was at least one correctional officer who conspired with the inmates to arrange assaults on convicted child molesters. At the women’s prison near Chino, five employees resigned in 1999 because of sexual misconduct allegations and there were 40 other officers that were said to be involved. The medical and mental-health care that inmates are receiving in California’s state prisons is appalling. Inmates have been seen using communal showers and have open, bleeding wounds (staph infections). Mentally ill inmates live in conditions that some experts have said are even worse than those of the old mental institutions. Some guards will use medication as a tool to punish an inmate if they act out. With-out the proper medication, the inmate can sometimes become psychotic, thus leading to solitary confinement. This is in no way a form of rehabilitation. It is inhumane. A psychiatrist (who specializes in prison mental health) by the name of Pablo Stewart testified before the panel of federal judges that the overcrowding alone has contributed the rise in mental illness amongst the inmates. He further stated that these inmates have â€Å"no privacy, no sense of personal space, sleep with the light continuously on, and must cope with constant noise which is like that of an airport runway.† â€Å"It has been estimated that California’s prison system â€Å"throws away at least $100 million a year because officials refused for decades to negotiate low rates with hospitals, as every insurance company does.† (Elias, T) Correctional officers who testified before the panel of three federal judges that â€Å"as many as 50 inmates at a time typically wait two to five hours inside a 12-foot by 20-foot holding area for medical or mental health treatment.† (Thompson, D)It was also stated that â€Å"suicidal inmates were kept overnight in cages the size of telephone booths until crisis cells became available† and â€Å"some of the more severely ill mentally ill inmates wait more than a year before they can be transferred to a mental health facility.† (Thompson, D) These correctional officers are also at risk because of these conditions. Inmate assaults against staff â€Å"increased between 1990 and 1995 and the number of attacks rose by nearly one-third, from 10,731 to 14,165†. (Gillan, T) There are thousands of inmates that are infected with the HIV virus and thousands more are carriers of hepatitis C. Officers of late now have to be concerned with a new form of assault from inmates called â€Å"gassing†. This type of assault is done by throwing a bag or cup of feces or urine at the officers as they pass by the inmate’s cell. California prisons are filled with gang members from the Aryan Brotherhood, the Bloods, the Crips, the Fresno Bulldogs, the Nazi Low-rider’s, and the Southsiders, which can lead to random acts of violence against correctional officers. Today, prison sentences are more intended to incapacitate rather than rehabilitate the offenders. . Rehabilitation has basically been abandoned and has been replaced with tough on crime attitudes that truly only seek to punish and protect society. California’s prisons use to be known as the California Department of Corrections. When Gov. Schwarzenegger took office, he changed the name to the California Department of Corrections and Rehabilitation. My question is this? What happened to the rehabilitation part of it? Our prisoners are in desperate need of education and rehabilitation. Most of them only have a seventh grade reading level, a huge percentage of them have substance abuse problems, and there is little or no motivation for any of them to participate in programs that were created to address those problems that led them to criminal behavior. What is happening is without any type of rehabilitation, these individuals will keep going through a revolving door that I like to refer to as the CDCR. Those who are incarcerated should have access to programs that address: 1. Academic, Vocational, and Financial 2. Alcohol and other Drugs 3. Anger, Aggression, Hostility, and Violence 4. Criminal Thinking, Associations, and Behaviors 5. Family, Martial, and Relationships 6. Sex Offending Programs like these would help to cut down on the revolving door effect. The biggest problem that I see in California’s state prisons is the rate of recidivism amongst its parolees. When an inmate is paroled, they leave the prison with no more than the clothes on their back, and $200 in gate money. Most of these individuals will have no place to live and no job to go too. Because of this situation, most parolees will return to the people and places that they are familiar with, thus leading to more criminal behavior. California’s parole system violates more parolees and sends them back to prison than any other state. Parolees are getting violated for a dirty test, missing a scheduled appointment, or not being able to provide an address as to where they live and are being sent back to prison for up to one year. California’s parole system needs seriously to consider other alternatives besides sending violators back to prison. This in itself could save the state hundreds of millions of dollars a year in unnecessary spending. There are some wonderful programs that are available to paroles in the state of California that help them receive their GED, and train them in different marketable skills. They are also taught important values, and the interpersonal and social skills that will eventually allow them to live successfully in the mainstream of our society. These programs definitely help to cut done on the rate of recidivism. Ray Procunier, who was the director of corrections under then Gov. Ronald Reagan, has said that â€Å"We don’t need all these punitive laws like the three strikes law.† He then went on to say that when Reagan was in office, they were able to â€Å"cut the prison population by one-third and there was no increase in crime, not even a blip.† (Elias, T) Procunier also believes that he â€Å"could bring down today’s prison population by 95,000 and no one would be hurt in the process.† Maybe Gov. Schwarzenegger needs have this man brought back in to clean this mess up. Up until now, California’s attitude regarding over-crowding has been to just build more prisons because they cannot seem to agree on anything else. One thing is clear, there needs to be a cap on the prison population. Without it, we are going to keep filling as many prisons as we build because we are not affecting the amount of individual’s that are going in. This morning I read an article in the local section of the newspaper. The article started by saying â€Å"In Kern County, you really cant swing a dead cat without hitting a parolee.† (Henry, L) Ms. Henry went on to write that are an estimated 5,450 parolees in Kern County, with an estimated 800 who are back in custody for violating their parole. The numbers are high because â€Å"Kern County prides itself on sending more people to prison per capita than any other county in the state.† Maybe then Kern County should start picking up the costs of housing all these parolees. Something has got to give. There is a saying in California and it goes something like this: Come on vacation, leave on probation, and return on a violation. A very sad but true statement. California’s prisons are a ticking time bomb just waiting to explode. Right now, there is not too much love and affection going on in the house of corrections. The CDCR needs a serious overhaul. Will the Governor be able to come up with a way to relieve the overcrowded conditions and implement some kind of satisfactory medical and mental healthcare for California’s inmates without having to ship them out of state? John Lockes Philosophy Of Education Philosophy Essay All the objects of the understanding are described as ideas, and ideas are spoken of as being in the mind. Lockes first problem, therefore, is to trace the origin and history of ideas, and the way in which the understanding operates upon them, in order that he may be able to see what knowledge is and how far it reaches. In the first book of the Essay, on the subject of innate ideas, Locke points to the variety of human experience, and to the difficulty of forming general and abstract ideas, and he ridicules the view that any such ideas can be antecedent to experience. All the parts of our knowledge, he insists, have the same rank and the same history regarding their origin in experience. All our ideas, he says, come from experience. The mind has no innate ideas, but it has innate faculties: it perceives, remembers, and combines the ideas that come to it from without; it also desires, deliberates, and wills; and these mental activities are themselves the source of a new class of ideas. Experience is therefore twofold. Our observation may be employed either about external sensible objects, or about the internal operations of our minds. The former is the source of most of the ideas which we have, and, as it depends wholly upon our senses, is called sensation. John Locke was a great education on several counts. In an immediate sense he was himself a practitioner and publicist of good education. This writing assignment is concerned with his biography, his philosophy of education, his advice to parents on the upbringing of their children, his philosophy of curriculum. Biography Lockes father, who was also named John Locke, was a country lawyer and clerk to the Justices of the Peace in Chew Magna, who had served as a captain of cavalry for the Parliamentarian forces during the early part of the English Civil War. His mother, Agnes Keene, was a tanners daughter and reputed to be very beautiful. Both parents were Puritans. Locke was born on 29 August 1632, in a small thatched cottage by the church in Wrington, Somerset, about twelve miles from Bristol. He was baptized the same day. In 1647, Locke was sent to the prestigious Westminster School in London under the sponsorship of Alexander Popham, a member of Parliament and former commander of the younger Lockes father. After completing his studies there, he was admitted to Christ Church, Oxford. Locke was awarded a bachelors degree in 1656 and a masters degree in 1658. He obtained a bachelor of medicine in 1674, having studied medicine extensively during his time at Oxford and worked with such noted scientists and thinkers as Robert Boyle, Thomas Willis, Robert Hooke and Richard Lower. Locke fled to the Netherlands in 1683, under strong suspicion of involvement in the Rye House Plot, although there is little evidence to suggest that he was directly involved in the scheme. In the Netherlands, Locke had time to return to his writing, spending a great deal of time re-working the Essay and composing the Letter on Toleration. Locke did not return home until after the Glorious Revolution. Locke accompanied William of Oranges wife back to England in 1688. The bulk of Lockes publishing took place upon his return from exile   his aforementioned Essay Concerning Human Understanding, the Two Treatises of Civil Government and A Letter Concerning Toleration all appearing in quick succession. He died in 28 October 1704, and is buried in the churchyard of the village of High Laver east of Harlow in Essex, where he had lived in the household of Sir Francis Masham since 1691. Locke never married nor had children. Philosophy of Education Although the Thoughts was most immediately concerned with education, by far the most important of Lockes writings, and one which had great significance for education, was the Essay concerning human understanding. Locke abandoned the attempt to make two unlike things influence each other. He begins his thinking with the thesis that the mind is a sort of blank tablet upon which the world of matter writes by means of sensations. This mind does not have innate or inborn ideas, but it does have the power to arrange impressions in such a way as to produce a consistent system of thoughts. Mind and body, for Locke, exist as real things, but they interact. Bodies act upon the mind and produce sensations. Ideas or perceptions of some of qualities of external objects are accurate copies of qualities that actually reside in the objects, Locke said. This is what he means. Think of a basketball. It has a certain size, shape, and weight, and when we look at and handle the ball, our sensory apparatus provides us with accurate pictures or images or ideas or perceptions of these primary qualities, as Locke called them. Lockes theory: According to Locke, when we say, we are looking at an external object, what we are really doing is attending to the perceptions or ideas of the object in our mind. Some of these perceptions, such as those of a basketballs size and shape, accurately represent qualities in the object itself. Other perceptions, such as those of the basketballs color do not represent anything in the object. Lockes purpose was to examine the nature and extent of human knowledge and the degree of assent should be given to any proposition. Lockes alternative image of the mind as a white paper void of all characters (Essay, 2.1.2) has often been interpreted as meaning that all human beings start as equals. Locke did not believe this; on the contrary, he was conscious that the differing personalities and mental and physical capacities of individuals were to some extent a product of nature rather of nature. How was knowledge acquired? How might men come to universal agreement? To this I answer, in one word, from experience (Essay, 2.1.2). But experience itself, gained via the senses, was not sufficient of itself for knowledge. That also required the active agency of mind upon such experience. Follow a child from its birth and observe the alterations that time makes, and you should find, as the mind by the senses comes more and more to be furnished with ideas, it comes to be more and more awake; thinks more, the more it has matter to think upon. After some time it begins to know the objects, which being most familiar with it, have made lasting impressions. Thus it comes, by degrees, to know the persons it daily converses with, and distinguishes them from strangers; which are instances and effects of its coming to retain and distinguish the ideas the senses convey to it (Essay, 2.1.22). The senses at first let in particular ideas, and furnish this yet empty cabinet and the mind by degrees growing familiar with some of them, they are lodged in the memory, and names got to them. Afterwards the mind, proceeding further, abstracts them, and by degree learns the use of general names. In this manner the mind comes to be furnished with ideas and language, the materials about which to exercise its discursive faculty. And the use of reason becomes daily more visible, as these materials that give it employment increase (Essay, 1.2.15). It must be admitted that Lockes derivation of all ideas ultimately from experience is not without its difficulties. Though, for Locke, experience embraced both sensation and reflection, clearly there are substantial qualitative differences between the simple sensations of infants, and the complex and abstract reflections of the mature adult mind. One way of attempting to resolve such difficulties is to recognize that Locke envisaged ideas of different types. Parents and children His medical knowledge contributed to a concern for the physical, as well as the mental and spiritual, well-being of children. He was not only a founder of empirical thought, with all that meant for ways of learning, but he also may be counted as a pioneer of scientific psychology. He believed in the importance of observing children, and of tailoring education to their needs and capacities. Thus his views on plenty of open air, exercise and sleep; plain diet, no wine or strong drink, and very little or no physick (Thoughts, s.30) would command general support today, though his advice on toughening the feet by wearing thin or leaky shoes so that gentlemans sons might acquire the ability, if necessary, to go barefoot as the poor do, might seem to be somewhat harsh. (Thought, s. 8). Food for children, according to Locke, should be plain and wholesome, with sugar salt and spices used sparingly. From the body Locke turned to the mind. He believe that parents should personally exercise firm and close authority over their children from an early age, with a view to relaxing this as they grow older. Fear and awe ought to give you the first power over their minds, and love and friendship in riper years to hold it (Thoughts, s.42). Locke criticized the over-indulgence of little children, and abhorred obstinate crying on their part, but had little use of any form of physical chastisement. He advised parents and tutors to their children and to note their dispositions and dislikes: for a child will learn three time as much when he is in tune, as he will with double the time and pains, when he goes awkwardly, or is dragged unwillingly to it (Thoughts, s.74). Toys should be simple and sturdy, possible fashioned by the children themselves, rather than expensive and fragile. The curriculum Locke had an overall view of the curriculum which was coupled with teaching methods. He believed in starting with the plain and simple, and of building, as far as possible, upon childrens existing knowledge, of emphasizing the interconnections and coherence of subjects. Children should be taught to read at the earliest possible age-as soon as they can talk. But the learning should not be irksome; on the contrary, Locke believed that it would be better to lose a whole year rather than to give a child an aversion to learning at this early stage. Locke commented upon how much energy, practice and repetition children happily put into play, and therefore suggested dice and play-things with the letters on them, to teach children the alphabet by playing (Thoughts, s.148). From letters they should proceed to syllables and then to easy and pleasant books, such as Aesops Fables, preferably in an edition which included pictures. Locke advocated the use of pictures of animals with the printed names to them (Thoughts, s.156). In recognition of the difficulties inherent in such essential learning as The Lords Prayer, Creeds and Ten Commandments, Locke recommended that these should be learned not from the printed word but orally and by heart. Locke warned against the use of the Bible as a reading book for children, a most common practice in this day, for what pleasure or encouragement can it be to a child to exercise himself in reading those parts of a book, where he understands nothing? (Thoughts, s. 158). Writing should begin with correct holding of the pen and the copying of large letters from a sheet. Writing would lead naturally to drawing, with due attention to perspective, a most useful skill for those who would engage in travel, so that buildings, machines and other interesting phenomena might be quickly sketched. Locke believed that a good drawing was more useful in conveying an idea to the mind than several pages of written description. Locke also urged the value of shorthand for the purpose of making quick notes. Other subjects which Locke commended for a gentlemans son included geography, arithmetic, astronomy, geometry, chronology, and history, and generally in that order. Lockes influence on contemporary education in Cambodia As we have known that John Locke is a great philosopher so his philosophies influences other countries include Cambodia as well. Lafeyette didn't like hanging around with Rickey's friends. During the final chapters of the novel, Lafeyette is accused of stealing car parts from a pick up truck. He would be charged and sentenced for one year of probation. Lafeyette becomes what LaJoe dreaded: Lafeyette turning out to be his older brother Terence. LaJoe: Lajoe is the mother of Lafeyette, Pharoah and to 5 other children. LaJoe has lived in the Horner home for most of her life. She moved to the Horner homes when she was 4 years old. Using two motivation theories of your choice, explain a) the similarities and the b) differences between the two theories. Among the various motivation theories, I chose Herzberg’s theory of motivation and Maslow’s hierarchy of needs. a) Similarities Herzberg is the person responsible for the birth of the two-dimensional paradigm of factors affecting people’s attitudes about work. This is sometimes called the two-factor theory. The factors involved are: hygiene factors and motivators. The presence of hygiene factors or dissatisfiers relate to the situation in which the person does what he or she does while motivators or the satisfiers relates to what a person does. Maslow introduced his hierarchy of needs which is about how people satisfy various personal needs in the context of their work. He also theorized that a person could not recognize or pursue the next higher need in the hierarchy until his or her currently recognized need was substantially or completely satisfied. The two aforementioned theories are similar in the context of recognizing that there are several factors/needs that affect a person’s attitude towards work. Particularly in Herzberg’s theory, factors may satisfy or dissatisfy a workers performance in the company; it can make them or break them. While Maslow’s hierarchy of needs stated that there are needs which one by one should be satisfied, so as to improve his capabilities as a person or as a worker in a company. These stages should be slowly and completely satisfied before going up on the pyramid of needs. So in onclusion, these two theories common denominator is the satisfaction of one’s needs for them to function more positively. In addition to their similarities, Herzberg’s hygiene factors and motivators are the same as the physiological needs in Maslow’s hierarchy of needs. b) Differences Herzberg’s theory of motivation involves the hygiene factors and motivators. These factors are different in a way that hygiene factors are called dissatisfiers while motivators are the satisfiers. Such factors like the company policy, interpersonal relations, supervision, working conditions and salary are hygiene factors. The absence of hygiene factors can create job dissatisfaction, but their presence does not motivate or create satisfaction. Motivators on the other hand, are the factors that enriched a person’s job. There are five determinants of motivators; achievement, recognition, works itself, responsibility and advancement. Maslow’s hierarchy of needs is named as follows, beginning from the bottom on the pyramid to the top; physiological needs, safety needs, social needs, esteem needs and self-actualization. As individuals satisfy one level of need, their motivation change as they aspire to reach the higher order needs. Physiological needs are thirst, hunger and sex. Safety needs are security, stability and protection. Social needs are the escape to loneliness, love and belongingness, to love and be loved. Esteem needs are self-respect, the respect to others. Self-actualization is to fulfill one’s potentialities. Basically, the two theories differ in the aspect of the recognition of the different factors or needs that a person/leader must take into consideration. Another thing is Herzberg’s theory is all about the factors which affect a person’s attitude about work while Maslow’s hierarchy of needs is all about the various personal needs in the context of their work. 2. Describe the benefits to an organization of having a motivated workforce. When an organization has a motivated workforce, the benefits are mutually gained. It’s like hitting two birds with one stone, it may sound redundant but yes, it’s true. You gain money and at the same time you gain your workers trust and camaraderie. For example, in our store, whenever there are high rate of sales, we give incentives. If there are times when we see that our workers have a hard time working, like stocks have arrived, we give extra snacks. We treat our workers not just workers in our store but also as a member of our family, but there are limitations and we draw the line between leader and worker so as to avoid abusive behaviors. During holiday seasons or birthdays, we invite them to join us in our trip. We saw this as a chance for us to get to know our workers better outside our store, how they are as an individual. We also go a little further in knowing what motivates them, what they want, and how to satisfy their needs, because knowing what motivates our workers makes our relationship in the store, easy and effective. 3. Analyze the difference between hygiene factors and motivators. Hygiene factors are called as the dissatisfiers; they are the job factors which are essential for motivation in a workplace. The presence of these factors does not lead to positive satisfaction for long term. But if these factors are absent or if these factors are non-existent at workplace, then they lead to dissatisfaction. In other words, hygiene factors are those factors which when adequate or reasonable in a job, pacify the employees and do not make them dissatisfied. These factors are extrinsic to work. Hygiene factors are also called as maintenance factors  as they are required to avoid dissatisfaction. These factors describe the job environment or scenario. The hygiene factors symbolize the physiological needs which the individuals wanted and expected to be fulfilled. Hygiene factors include: ? Pay- The pay or salary structure should be appropriate and reasonable. It must be equal and competitive to those in the same industry in the same domain. Company Policies and administrative policies- The company policies should not be too rigid. They should be fair and clear. It should include flexible working hours, dress code, breaks, vacation, etc. ? Fringe benefits- The employees should be offered health care plans, benefits for the family members and employee help programmes. ? Physical Working conditions- The working conditions should be safe, clean and hygienic. The work equipments should be updated and well-maintained. ? Status- The employees’ status within the organization should be familiar and retained. Interpersonal relations-The relationship of the employees with his peers, superiors and subordinates should be appropriate and acceptable. There should be no conflict or humiliation element present. ? Job Security- The organization must provide job security to the employees. Motivators on the other hand are factors which are inherent to work. These factors motivate the employees for a superior performance. These factors are called satisfiers. These are factors involved in performing the job. Employees find these factors intrinsically rewarding. The motivators symbolized the psychological needs that were perceived as an additional benefit. Motivational factors include: ? Recognition- The employees should be praised and recognized for their accomplishments by the managers. ? Sense of achievement- The employees must have a sense of achievement. This depends on the job. There must be a fruit of some sort in the job. ? Growth and promotional opportunities- There must be growth and advancement opportunities in an organization to motivate the employees to perform well. ? Responsibility- The employees must hold themselves responsible for the work. The managers should give them ownership of the work. They should minimize control but retain accountability. 4. Evaluate the benefits to organizations of using different motivation approaches. If an organization uses different kinds of motivation approaches, they are more likely to achieve a better workplace with workers who are well motivated. Why is this so? because the different theories of motivation suggests a lot of tips and challenges for the company to apply for them to achieve a better and happier people in the working department. Another is that the company leaders will be able to satisfy every members needs leading to satisfaction and motivation, as well as avoiding the dissatisfiers that might result to drawbacks. Motivating the members of your company makes them more committed and they will trust you because they will feel that they are important to the company they are working into. Applying various types of motivation theories also makes the working environment more exciting and interesting, so your workers are more enthusiastic in coming to work every day and ultimately making productive, profitable and competitive business.
